I. The commune of Smętowo Graniczne is:
1) a local government community forming a local government unit within the meaning of art. 15 paragraph 2 and 16 paragraph 1 of the Act of April 2, 1997. The Constitution of the Republic of Poland and art. 1 item 1 of the Act of March 8, 1990. on communal self-government,
2) a legal person within the meaning of section II of the Act of April 23, 1964. Civil Code and art. 2 clause 2 of the Act of 8 March 1990 on commune self-government.
II. The name of the commune Smętowo Graniczne comes from the name of the city Smętowo Graniczne, which in a two-part form was determined by Regulation No. 129 of the Prime Minister of September 22, 1953. on establishing and changing the names of certain localities in the Olsztyn, Gdańsk and Bydgoszcz provinces (MP of 14. October 1953, No. A-92, item 1240, entered into force on October 14, 1953)
