About

context
Four years after the revolution, Tunisia emerged in December 2014 from a long period of transition, which allowed the adoption of a new Constitution, the establishment of a democratically elected Parliament and the election of a new President.

Tunisia must now fulfill the promises, guarantee the constitutional achievements and tackle an important reform process, particularly in the judicial and penitentiary sector. Some of the work priorities include:

Compliance of legislative texts with international standards;
Improvement of the independence and impartiality of justice;
Improved access to justice and state legal aid;
Reform of the Code of Criminal Procedures, including its article 13 guaranteeing the systematic presence of the lawyer in police custody;
Enlargement and respect of public freedoms;
Respect for the rights of defense and fair trial;
Realization of the mechanisms put in place to face the past: to allow victims to be rehabilitated and bring justice for State crimes committed during the dictatorship and the revolution (Truth and Dignity Commission and specialized chambers).
Other sectors and themes remain important issues for Tunisia: respect for freedoms and in particular freedom of expression, establishment of participatory local governance, respect for economic and social rights, rights of migrants, resource management natural resources and legal liability of companies, especially foreign ones.

It is in this context that ASF works, through the implementation of several projects in partnership with Tunisian actors (human rights NGOs and legal professionals): the aim is both to support them in the reform of the justice, in the achievement of transitional justice, in respect for human rights and in the creation of accessible and quality legal aid services.
