Assignment Title:     Selection of a consulting firm to update the Angolan veterinary legislation for MOSAP 3.

The Ministry of Agriculture and Forestry (MINAGRIF) has received financing from the World Bank toward the cost of the Smallholder Agricultural Transformation Project (MOSAP 3), and intends to apply part of the proceeds for consulting services.

The consulting services (“the Services”) include, among others, to carry out legal technical work that will lead to the updating of the Veterinary Legislation in Angola; conduct an assessment to the current existing veterinary legislation on terrestrial and aquatic animals, including pets and laboratory animals; review the primary and secondary veterinary legislation in force in the country, particularly on aspects such as animal health and welfare, production, registration, identification and animal traceability; Consult the stakeholder on the Veterinary Legislation in Angola and collect proposals for improvement; comply with the general principles established by WOAH regarding, the normative hierarchy, legal basis,  transparency, consultation and quality of legislation and legal certainty; elaborate an updated veterinary legislation in Angola that includes, among others, aspects such as  (a) a clearly establishment of normative powers, rights, responsibilities and obligations, (b) be accurate, clear and precise, be unambiguous and use coherent terminology, (c) include exclusively those definitions that are necessary and relevant for the country, (d) contain definitions or provisions that will not create unnecessary contradictions or duplication, € clearly state the scope and objectives, (f) provide for the application of proportional and dissuasive penalties and sanctions, whether criminal or administrative, depending on the situation, (g) when proceeding, provide for the collection, use and dissemination of updated information pursuant to veterinary legislation, (h) have the necessary resources to carry out the activities activities delegated by competent authorities, unless these activities are supported by adequate funding from the national budget, and (i) indicate the date of entry into force and its impact on existing similar legislation, particularly, the secondary legislation; set up a legislate on Competent Authorities as regards to (a) essential powers of the competent authority, (b) delegation of powers by the competent authority, and (c) Public-private partnerships (PPP) related to veterinary and livestock. The estimated level of effort is three-men-month and the contract duration period shall be one hundred eighty (180) days. The consultant firm is expected to commence services by no later than December 1st, 2023 or earlier.

The Smallholder Agriculture Transformation Project (MOSAP 3) now invites eligible Consultant firms to indicate their interest in providing the Services. Interested Consultant firms should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The shortlisting criteria are: (i) have proven experience in drafting primary and secondary legislation, especially in the fields of veterinary and livestock sciences, wherein at least five (5) years of relevant experience in fields related to public law, as a researcher or consultant in the field of legal sciences; (ii) be in good standing with regard to social security contributions; (iii) Work experience in national and international legal and labor legislation, in the field of veterinary and livestock and ability to work independently and generate results in a timely manner. Key Experts will not be evaluated at the shortlisting stage.

The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” [Ed. November 2020 (“Procurement Regulations”)], setting forth the World Bank’s policy on conflict of interest. Consultant firms may associate with other firms to enhance their qualifications, but should indicate clearly whether the association is in the form of a joint venture and/or a sub-consultancy. In the case of a joint venture, all partners in the joint venture shall be jointly and severally liable for the entire contract, if selected.

A Consultant firm will be selected in accordance with the Quality and Cost-based selection (QCBS) method set out in the Procurement Regulations.
