The Government of Kenya (GoK) has received financing from the World Bank’s International Development Assistance (IDA) towards the cost of the Kenya Petroleum Technical Assistance Project (KEPTAP) whose overall objective is to strengthen the capacity of the Government of Kenya to manage its petroleum sector and accruing wealth for sustainable development. It is intended that part of the proceeds of this credit be applied to eligible payments under the contracts for provision of consultancy services for the Development of Petroleum Policy.

The consultancy will run for a period of three (3) months

Objective

The objective of this assignment is to support the State Department of Petroleum in drafting a comprehensive petroleum policy that provides strategic direction and clarity on key sector issues enhancing the revised legislative framework for the development of the national petroleum resources.

The scope of the assignment will include but not limited to: - 

  1. Familiarize with existing petroleum legal, fiscal and regulatory framework and planned revisions. This includes, however, not limited to: Petroleum Act, Energy Policy, Model PSC, Hunton & Williams 2013 Legal & Regulatory Framework study 2015, 2014 Draft Local Content Regulations, the Study “Towards an Oil & Gas Master Plan in Kenya”, Institutional Review study report 2017.
  2. Highlight the key aspirational policy decisions to be made and the strategic options for oil and gas sector developments in Kenya, this includes highlighting the differences between oil versus gas developments, on-shore versus off-shore.
  3. Familiarize with the views and policy objectives of different government agencies in oil and gas with regards to the development of the upstream, midstream, and downstream oil and gas industry.
  4. Identify the petroleum sector (upstream, midstream, downstream) gaps in the Energy Policy
  5. Identify which petroleum sector element are still valid when separating these from the overall Energy Policy
  6. Identify which elements of the Energy Policy relevant to the petroleum sector need separation
  7. Propose recommendations addressing the findings
  8. Develop a draft stand-alone petroleum policy in view of the revised legislative (Petroleum Bill, Energy Policy, Upstream regulations and the institutionalization of an upstream regulatory authority.
  9. The draft Petroleum Policy to include but no limited to:
    1. Petroleum Policy Objectives
    2. Gathering and evaluation of petroleum data
    3. Exploration and production licensing
    4. Prior concessions strategy
    5. State participation and the National Corporations
    6. Administration of laws relating to the development and exploitation of natural resources
    7. Institutional reforms (roles and responsibilities)
    8. Petroleum revenue collection and administration
    9. Revenue management and transparency
    10. Revenue distribution between national and sub-national authorities
    11. Fiscal policies to mitigate the macro-economic challenges of resource-rich countries
    12. Policies to address the finite nature of natural resource endowments that can sustain long-term growth and development
    13. Policy coherence across different sectors and government agencies to use petroleum resources for sustainable impacts
    14. Oil and gas infrastructure
    15. Oil and gas price setting mechanisms in the domestic market
    16. Occupational Health and Safety
    17. Social development to reduce poverty and vulnerability
    18. Development of human resource capacity
    19. Local content development
    20. Environmental protection
    21. Frameworks for sector planning ie Petroleum Master Planning
    22. Support for monitoring and evaluation of sector policies implementation, and development of Ministry of Petroleum and Mining data collection and reporting, to provide indicators of the ministry’s own performance as well as statistics on the petroleum sector overall.

The Ministry of Petroleum and Mining (MoPM) through the Project Management Unit (PMU) (Client) now invites eligible consulting firms (“Consultant”) to indicate their interest in providing the consultancy Services. Interested Consultants should provide information in a short format demonstrating that they have the required qualifications and relevant experience to perform the Assignment. The shortlisting criteria include; Significant international experience in advising Governments regarding the development of petroleum policy and strategy, preferably in countries with similar stage of up-, mid-, and downstream sector. Knowledge of petroleum legislative framework within Kenya and the region. Demonstrable track record of success i.e. acceptance of the drafted policy. Provide evidence for relevant projects (minimum 3) successfully completed, clearly indicating the year undertaken, the country, and the name of the client and project/report acceptance confirmation by the client. Contribution of experienced national expert(s) in Kenya’s petroleum sector is preferred.

The attention of interested Consultants is drawn to paragraph 1.9 of the World Bank’s Guidelines: Selection and Employment of Consultants [under IBRD Loans and IDA Credits & Grants] by World Bank Borrowers January 2011 (“Consultant Guidelines”), setting forth the World Bank’s policy on conflict of interest.

Consultants may associate with other firms in the form of a joint venture or a sub-consultancy to enhance their qualifications.

A Consultant will be selected in accordance with the Quality & Cost-Based Selection (QCBS) method set out in the Consultant Guidelines.
