Contract specifications 6.Contract description: The contract entails: — carrying out rehabilitation works, with stabilisation of the wearing course using a water-repellent agent (soil improvement chemicals), on approximately 116 km of earth roads, including the construction of a slab bridge of approximately 42 linear metres in length, — carrying out major reshaping works and treatment of critical points on approximately 204 km of earth roads. 7.Number and titles of lots: 2 lots: lot 1: — firm phase: major reshaping works and treatment of critical points on the Mankono-Dianra (108,5 km) and Séguéla-Sifié (66,5 km) roads, — conditional phase: major reshaping works and treatment of critical points on the Mankono-Kongasso (30 km) road; lot 2: — rehabilitation works on the Mankono-Séguéla-Tiéningboué road (116 km) and construction of a slab bridge of approximately 42 linear metres in length over the Kohoué. Conditions for participation 8.Eligibility and rule of origin: Participation in the contract is open on equal terms to all natural persons and legal entities (irrespective of whether they are taking part as individuals or as part of a grouping (consortium) of tenderers) from the EU Member States and the ACP countries and territories, and also to international organisations, as authorised by the instrument applicable to the programme under which the contract is financed (see also point 22 below). All the goods supplied under this contract must originate in these countries. 9.Grounds for exclusion: Tenderers must sign and submit the declaration, included with the tender form for a works contract, to the effect that they are not in any of the situations listed in section 2.3.3 of the Practical Guide to contract procedures for EU external actions. 10.Number of tenders: Tenderers may not submit more than 1 tender per lot. Tenders for part of a lot will not be considered. Tenderers may state in their tender whether they would grant a discount should they be awarded several lots. Tenderers may not submit a variant tender in addition to their tender for the work required in the invitation to tender dossier. 11.Tender guarantee: Tenderers must furnish a tender guarantee of: — lot 1: 65 000 EUR, — lot 2: 65 000 EUR, when they submit their tenders. This will be returned to unsuccessful tenderers once the invitation to tender procedure has been completed and to the successful tenderer(s) once the contract has been signed by all parties. 12.Performance bond: The successful tenderer will be required to provide a performance bond for 5 % of the contract value when the contract is signed. The bond must be furnished within 30 days of the date on which the tenderer receives the contract signed by the contracting authority. If the successful tenderer does not provide the bond within the time allowed, the contract will be rendered void and a new contract may then be drawn up and sent to the tenderer who submitted the second lowest-priced compliant tender. 13.Briefing and/or site visit: A briefing will be organised on 18.10.2010 from 9:00 to 11:00 at the Côte d’Ivoire/European Union Cooperation Coordination Unit. Tenderers wishing to attend this briefing are requested to write to the contact person mentioned below before 11.10.2010 to settle the practical arrangements. E-mail: herve.nzai@cccciue.ci 14.Tender validity: Tenders are to be valid for 90 days from the final date for submission of tenders. 15.Implementation deadline: Lot 1: 14 months; lot 2: 18 months. Selection and award criteria 16.Selection criteria: 1) Tenderer’s economic and financial capacity (criterion assessed in accordance with form 4.4 of Volume 1 — Section 4 of the invitation to tender dossier): (a) the average annual value of works undertaken by the tenderer over the past 3 years (2007, 2008 and 2009) must equal or exceed 10 000 000 EUR excluding taxes; (b) the tenderer must have access to credit or other financial facilities of at least 1 000 000 EUR, either in the form of bank or supplier credit lines or its own working capital from the past financial year (2009). 2) Tenderer’s professional technical capacity (criterion assessed in accordance with form 4.6.4 of Volume 1 — Section 4 of the invitation to tender dossier): (c) the tenderer must have successfully completed over the past 5 years (2005–2010): — lot 1 and/or lot 2: 1 road construction project with a value of at least 10 000 000 EUR excluding taxes, — lot 2: 1 concrete bridge of at least 60 linear metres in length. (NB: a road construction project is taken to mean a road project including construction of a structure, or a civil engineering structure project). In order to demonstrate successful completion of the contracts performed, the tenderer must provide copies of the certificates of final acceptance, certificates of satisfactory performance or equivalent documents, signed by the project managers or contracting authorities for the projects in question; (d) the tenderer must have sufficient personnel to successfully carry out the proposed contract. The list of essential personnel, as a minimum, required to carry out the contract is given in Section I of the ‘Instructions to tenderers’ under Article 12.1.9. (e) The tenderer must have the relevant equipment to successfully carry out the proposed contract.
