Description

Department of Natural Resources and Environment of Son La province was established under Decision No. 145/2003 / QD-UBND dated September 12, 2003 of the People's Committee of Son La province on the basis of merging the organization of the Department of Land Administration and the organize the implementation of the state management function of water resources, mineral resources and environment under the Department of Agriculture and Rural Development; Department of Industry; Department of Science, Technology and Environment under Decision No. 45/2003 / QD-TTg dated April 2, 2003 of the Prime Minister.

Being a specialized agency of Son La People's Committee, advising and assisting the Provincial People's Committee in performing the state management function in the field of natural resources and environment, including: Land, water resources, mineral resources, geography quality, environment, hydrometeorology, climate change, measurement and mapping, land valuation and implementation of public services in the fields under the Department's management. Department of Natural Resources and Environment has legal status, its own seal and account; responsible for directing and managing the organization, personnel and work of the provincial People's Committees; at the same time subject to the direction, guidance, examination and professional skills of the Ministry of Natural Resources and Environment

Functions, duties and powers of the Department of Natural Resources and Environment of Son La province are specified in the Decision No. 23/2015 / QD-UBND dated July 28, 2015 on defining the functions, tasks and rights term and organizational structure of Department of Natural Resources and Environment

1. Submit to the Provincial People's Committee
a) Draft Decision and Directive; Planning, Long-term, 5-year and annual plans; Programs, Schemes, Projects, measures to organize the implementation of tasks on natural resources and environment and state administrative reform under the Department's state management;
b) Draft of documents defining the functions, tasks, powers and organizational structure of the Department of Natural Resources and Environment;
c) Draft of documents defining conditions, standards and titles for heads and deputy heads of units of the Department; Chief, Deputy Head of the professional department of the district People's Committee within the scope of state management assigned.
2. Submit to the Chairman of the provincial People's Committee
a) Draft of documents under the promulgating competence of the Chairman of the Provincial People's Committee on natural resources and environment field;
b) Draft of Decision on establishment, merger, division, dissolution, reorganization of organizations and units of Department of Natural Resources and Environment;
c) Draft of documents regulating the relationship and coordination of work between the Department of Natural Resources and Environment and related departments, agencies and People's Committees at district level.
3. Organizing the implementation of legal documents, plannings, plans, programs, schemes and projects on natural resources and environment after they are approved; information, propaganda, guidance, dissemination, education, monitoring of law enforcement and raising public awareness about natural resources and environment in the area.
4. Managing and organizing the assessment, registration, licensing, diplomas and certificates within the scope of their management functions and tasks according to the assignment, decentralization or authorization of the provincial People's Committee and the president of the provincial People's Committee.
5. About Land
a) Preside and coordinate with relevant agencies to prepare and adjust land use plannings and plans to submit to the provincial People's Committee; guide, monitor and inspect the implementation of approved land use plannings and plans;
b) Organizing the appraisal of land use plannings and plans submitted by the district People's Committee to the provincial People's Committee for approval; monitor and inspect the implementation of approved district-level land use plannings and plans;
c) To advise and assist the Provincial People's Committee in setting quota for allocation and recognition of residential land to households; limits of recognizing land use rights for households and individuals that clear land by themselves for agricultural production; quota for allocation of bare land, bare hills, land with water surface in the unused land group to households and individuals; minimum area for splitting the plot and other contents in accordance with the law on land;
d) Assessing documents about land allocation, land lease, land recovery, transfer of land use right, change of land use purpose, grant of certificate of land use right, ownership of houses and properties other associated with the land in accordance with the law; organize the appraisal of compensation and support plans for resettlement according to its competence; assisting the Chairman of the Provincial People's Committee in requisitioning land according to regulations;
d) To register land and properties attached to land, issue certificates of land use rights, ownership of houses and other land-attached assets, sign land lease contracts; preparing, managing, updating and adjusting cadastral records for foreign organizations, religious establishments, organizations and individuals, and overseas Vietnamese implementing investment projects according to regulations. ;
f) To organize the implementation of, and guide the examination of, surveys and assessment of land resources; land survey, survey, measurement and evaluation; making, adjusting and managing cadastral maps; statistics, inventory, mapping the current status of land use; building and operating a monitoring and evaluation system for land management and use;
g) Take charge of organizing the construction and adjustment of land price list to submit to the Provincial People's Committee for regulation; land price mapping; advising and dealing with problems related to land prices;
h) Assuming the prime responsibility for organizing the determination of specific land prices as a basis for calculation of land use levy, land rent, calculation of land use right value upon equitization of State enterprises, calculation of compensation amounts when land reclaimed land and other cases as prescribed by law and submitted to the Provincial People's Committee for decision;
i) Develop, manage, exploit and provide land information and database according to regulations;
j) Assuming the prime responsibility for, and coordinating with the concerned agencies in, guiding, inspecting and organizing compensation, support and resettlement for cases of land recovery according to law provisions;
l) Checking and organizing the implementation of land fund development; land fund management and exploitation; organize land use right auction according to regulations.
6. Regarding Water Resources
a) Making and implementing master plan on water resources, basic survey plan, regulating, distributing water resources, restoring polluted, depleted water sources; supervise activities of exploiting, using and protecting water resources, preventing, fighting and overcoming harmful effects caused by water on intra-provincial river basins;
b) Delineation of restricted areas, restricted areas, areas for registration of underground water exploitation, areas requiring artificial supplementation of underground water and announcement of minimum flow, threshold of underground water exploitation according to their competence, restricted areas , areas temporarily forbidden to exploit sand, gravel and other minerals in the river; make a list of lakes, ponds and lagoons that cannot be leveled;
c) Develop and manage the monitoring system of exploitation and use of water resources, discharge of sewage into water sources for intra-provincial river basins;
d) Organizing the response and handling of incidents of pollution of water sources; monitor, detect and participate in solving incidents of inter-country water pollution according to its competence; establishment and management of water source protection corridors, hygiene protection areas where domestic water is taken; ensure water sources for daily-life water supply in case of drought, water shortage or pollution of water sources;
d) To appraise dossiers of granting, extending, adjusting, suspending, withdrawing and re-granting permits on water resources and permitting the transfer of right to exploit water resources according to competence; collecting charges and fees for water resources, collecting charges for granting water right as prescribed by law; guide the registration of exploitation and use of water resources;
e) Organize the implementation of basic investigations and supervision of water resources as decentralized; inventory, statistics and store data on water resources in the area; report to the Ministry of Natural Resources and Environment on the results of basic surveys on water resources, the situation of management, exploitation, use and protection of water resources, as well as the prevention of, combat against and overcoming of harmful effects caused by water on locality;
g) Summary of situation of exploitation and use of water and waste sources into water sources in the locality; make a list of polluted, degraded and depleted water sources;
h) Instruct, monitor and inspect the filling of unused wells as prescribed by law.
7. Regarding Mineral Resources
a) Zoning areas banned from mineral activities, areas temporarily banned from mineral activities; identify areas not auctioned mineral rights under the authority of the provincial People's Committee; propose to the Provincial People's Committee measures to protect unexploited minerals; planning and organizing auctions of mining rights under the licensing authority of the Provincial People's Committee after being approved;
b) Formulate plans for exploration, mining and use of local minerals in accordance with regulations; promptly detect and report to the Provincial People's Committee and the Ministry of Natural Resources and Environment when discovering new minerals; appraising dossiers of recognition criteria for calculating mineral reserves; dossiers of approving mineral reserves; statistics and inventory of mineral reserves under the licensing authority of the Provincial People's Committee;
c) Organizing the evaluation of applications for issuance, extension, revocation and return of licenses for mineral exploration and mining licenses; files for transfer of rights to explore and exploit minerals; dossiers returning part of the area for mineral exploration and mining; mine closure project; auction documents of mining rights under the deciding competence of the Provincial People's Committee; organize the appraisal of charges for granting mineral mining rights under its jurisdiction;
d) Organizing the appraisal of reports on exploration results of minerals used as common construction materials and peat under the approving competence of the provincial People's Committee;
dd) Manage, store and provide information and materials on mineral exploration as common construction materials and peat; make statistics and inventory of approved mineral reserves and periodically report them to the Ministry of Natural Resources and Environment according to regulations;
e) Setting the royalty calculation price for minerals without the royalty calculation price or adjusting the royalty calculation price because it is no longer suitable as prescribed.
