What You’ll Be Doing

Nathan Associates, a Cadmus company, is seeking an Export Guarantee Scheme Expert. The consultant will conduct a detailed and comprehensive study to evaluate the necessity and types of export guarantees, analyze their advantages and disadvantages, and provide recommendations for implementing these instruments in the specific context of Moldova’s economy and its integration objectives. Through careful assessment of local needs and context, specific recommendations are necessary for the development of an export guarantee fund that meets EU standards and contributes to competitiveness and Moldova’s export capacity.

We anticipate up 40 days Level of Effort including 2 one-week trips to Moldova to perform local research.

Ultimately, the results of this study will provide the necessary information and guidance to develop and implement a robust and efficient concept for supporting domestic exporters, in line with the country's association and European integration objectives.

Project Background

The Moldova Institutional and Structural Reforms Activity (MISRA) is a five-year project funded by the US Agency for International Development (USAID) that aims to improve the business, investment, and trade enabling environment in cooperation with the Government of Moldova (GoM) to respond to an unprecedented economic crisis due to the war in Ukraine, as well as to support Moldova’s economic recovery, including to: advance the GoM’s economic action plan; strengthen public economic governance institutions; improve transport, logistics, trade, and commerce; and accelerate financial sector reforms and inclusiveness; among other needs. USAID MISRA is also building the capacity of the GoM to better engage and strategically communicate its economic plan, progress, and results to the private sector, civil society, and the public. These activities include intensive support to select GoM institutions with institutional reforms, streamlined processes, and digitalization to improve transparency, accountability, access to information, and public services.

Responsibilities:

The consultant will be responsible for the following tasks:

  • Engage with relevant government and private sector stakeholders to assess the difficulties (related to financing) in accessing foreign markets for the export of local goods and services
  • Conduct a comparative analysis of the local legal and regulatory framework related to the financing support measures for exporters and OECD arrangements and EU appropriate directives
  • Asses the role of Public Institutions in providing direct financial support to exporting companies and formulate recommendations for a viable intervention scheme
  • Develop an export guarantee scheme concept for Moldova, that will incorporate the best OECD and EU practices regarding the types of export guarantee facilities, adequate conditions on issuing, pricing, risk management, claims and monitoring, all in accordance with OECD arrangements, EU regulations and EU directives, including the EU and Moldovan state Aid rules
  • Offer support in aligning the existing support measures with the OECD and EU conditions and limitations regarding the export credit guarantees

Qualifications:

  • Bachelor’s degree in Finance, Economics, or Law
  • Ten or more years of professional experience in financial markets, banking, non-bank lending sector, or financial sector supervisory authorities
  • Previous experience reviewing national legal and regulatory frameworks on export guarantees
  • Advanced knowledge of financial instruments associated with export transactions, such as letters of credit, bank and state guarantees, etc.
  • Understanding of economic sectors and specific export procedures for each type of activity, including those with export potential
  • Strong, demonstrated knowledge of the OECD Arrangements, EU Directives and Regulations, particularly those related to export guarantees
  • Knowledge of the EU State AID rules
  • Experience working with USAID and/or other international donors preferred

Deliverables:

Export guarantee scheme concept for Moldova, that will incorporate the best OECD and EU practices regarding the types of export guarantee facilities, adequate conditions on issuing, pricing, risk management, claims and monitoring, all in accordance with OECD arrangements, EU regulations and EU directives, including the EU and Moldovan state Aid rules

Guidelines for updating the internal policies and procedures of Public Institutions, related to issuing export guarantees/insurance/finance, in accordance with the applicable OECD arrangement and EU regulations and directives

Comprehensive report recommending specific interventions to address policies, laws and regulations, and practices for improving export credit guarantee scheme and aligning the existing support measures with the OECD and EU conditions and limitations regarding the export credit guarantees (EU Regulation No 1233/2011 and EU Directive 98/29/EC

Reporting:

In addition to the deliverables above, the consultant will provide brief weekly reports to Component 3 Team Lead and Financial Sector Specialist, summarizing their progress. The expert will also contribute to other reports and documents as required consistent with this scope of work.
