The King appoints the Head of Government within the political party that wins the elections for members of the House of Representatives, and in view of their results. On the proposal of the Head of Government, he appoints the members of the government (Article 47 of the constitution).

 

The new constitution of the Kingdom, voted in a referendum on 1 st July 2011 brought a qualitative change of the functions of "Head of Government", the new name which replaced that of "Prime Minister", under the provisions of this constitution. The main responsibilities of the Head of Government can be summarized as follows:

- The Head of Government exercises regulatory power and may delegate some of his powers to ministers (article 90 of the Constitution)

of deans and directors of schools and higher institutes, as well as the appointment to the high functions mentioned by organic law 12-02. The Head of Government informs the King of the conclusions of the deliberations of the Council of Government.

- The Head of Government can request the meeting of the Council of Ministers (article 48 of the Constitution). The Council deliberates on the strategic orientations of the State policy, of the constitutional revision projects, of the organic bills, the general orientations of the finance bill, of the framework bills, of the draft law. amnesty, draft texts relating to the military field, the declaration of a state of siege, the declaration of war, the draft decree dissolving the Chamber of Representatives, the appointment to certain civilian posts and the appointment of managers of strategic public establishments and companies.

- The head of government may, on delegation from the King, chair the Council of Ministers on the basis of a determined agenda (article 48 of the Constitution)

- The Head of Government may, on delegation from the King, chair the Superior Security Council, on the basis of a determined agenda. (article 54 of the Constitution)

- The Head of Government appoints to civilian posts in public administrations and to high positions in public establishments and enterprises, without prejudice to the provisions of article 49 of the Constitution. He can delegate this power. (article 91 of the Constitution)

- The Head of Government proposes the candidates for appointment to the civilian posts mentioned in article 49 of the Constitution.

- The head of government can ask the King to terminate the functions of one or more members of the government

- The Head of Government can ask the King to terminate the functions of one or more members of the government because of their individual or collective resignation. Following the resignation of the Head of Government, the King terminates the functions of the entire government. The resigning government takes care of current affairs until the constitution of the new government.
