SPECIFIC PROCUREMENT NOTICE

CONSULTANT FOR TARIFF STUDY AND TARIFF PLAN

1. The Republic of Ghana (the “Republic”) and the Millennium Challenge Corporation (“MCC”) have entered into a Millennium Challenge Compact for Millennium Challenge Account assistance to help facilitate poverty reduction through economic growth in Ghana (the “Compact”) in the amount of Four Hundred and Ninety Eight Million, Two Hundred Thousand United States Dollars (US$ 498,200,000) (“MCC Funding”) and Thirty Seven Million, Three Hundred and Sixty Five Thousand United States Dollars (US$37,365,000) (“Republic Funding”). The Government of Ghana (“GoG”), acting through the Millennium Development Authority (“MiDA” or “MCA Entity”), intends to apply a portion of the MCC Funding to eligible payments under a contract for which the Request for Proposals is issued. Any payments made under the proposed contract will be subject, in all respects, to the terms and conditions of the Compact and related documents, including restrictions on the use of MCC funding and conditions to the disbursements of MCC funding. No party other than the Government of Ghana and MiDA shall derive any rights from the Compact or have any claim to the proceeds of MCC Funding.
2. The goal of the Compact program is to reduce poverty through economic growth in Ghana. The objectives of the Compact program are to
(a) Increase private sector investment and productivity and profitability of micro, small, medium and large scale businesses;
(b) increase employment opportunities for men and women; and
(c) raise earning potential from self-employment and improved outcomes for men and women.
The Program consists of six (6) projects: (i) the ECG Financial and Operational Turnaround Project; (ii) the NEDCo Financial and Operational Turnaround Project; (iii) the Regulatory Strengthening and Capacity Building Project; (iv) the Access Project; (v) the Power Generation Sector Improvement project; and (vi) the Energy Efficiency and Demand Side Management Project.
MCC’s assistance will be provided in a manner that responds to constraints to economic growth by aiming to improve the reliability and quality of power in Ghana.
The Compact Program will be executed over a period of five (5) years upon Entry into Force (EIF) of the Compact. There will be an initial period of Compact Implementation Funding (CIF) to be used by the Government of Ghana and MiDA to facilitate the implementation of the Compact.
4. MiDA now invites proposals to provide the consultant services referenced above (“Proposals”). More details on these consultant services are provided in the Terms of Reference.
5. The Request for Proposal (“RFP”) is open to all eligible entities or persons (“Consultants”) who wish to respond. Consultants may only associate with each other in the form of a joint venture or in a sub-consultancy agreement to complement their respective areas of expertise to enhance their capacity to successfully carry out the assignment and so long as any association is otherwise formed in accordance with the terms of the RFP.
6. Consultants are hereby put on notice that the Consultant who is awarded the Contract for the MiDA Tariff Study and Tariff Plan shall be precluded from bidding for the “Concession for the Management and Operation of, and Investments in, the Electricity Company of Ghana (ECG)” which is due to be advertised by the Government of Ghana in 2016.”
7. A Consultant will be selected under the Quality and Cost Based Selection (QCBS) method, the evaluation procedure for which is described in sections of the RFP in accordance with “MCC Program Procurement Guidelines” which are provided on the MCC website: www.mcc.gov.
8. The RFP Document includes the following Sections:
Section 1 Instructions to Consultants
This section provides information to help potential Consultants prepare their Proposals; it also provides information on the submission, opening, and evaluation of Proposals and on the award of the proposed contract.
Section 2 Proposal Data Sheet
This section includes provisions that are specific to this procurement and that supplement Section 1, Instructions to Consultants.
Section 3 Qualification and Evaluation Criteria
This section specifies the qualifications required of the Consultant and the criteria to be used to evaluate the Proposal.
Section 4A Technical Proposal Forms
This section provides the Technical Proposal Forms which are to be completed by a potential Consultant and submitted in a separate envelope as part of a potential Consultant’s total Proposal.
Section 4B Financial Proposal Forms
This section provides the Financial Proposal Forms which are to be completed by a potential Consultant and submitted in a separate envelope as part of a potential Consultant’s total Proposal.

This section includes the detailed Terms of Reference for this procurement that describe the nature, tasks and duties of the consultant services to be procured.
9. Prospective Consultants interested in submitting a Proposal should send an e-mail, giving full contact details of the Consultant, to the MiDA Procurement Agent at [email protected]. Before applying, interested consultants should review the Terms of Reference, which are in the Request for Proposals (RFP) Document. The RFP will be issued on application to the MiDA Procurement Agent at [email protected].
10. A pre-Proposal meeting will be held at World Trade Center, 29 Independence Avenue, Accra on 6th April 2016 at 10:00 hours as specified in the Proposal Data Sheet. Attendance is strongly advised for all prospective Consultants or their representatives but is not mandatory.
11. The closing time for receipt of Proposals is 29th April, 2016 at 15:00 hours local time in Ghana. Proposals received after this time and date shall not be considered and will be returned unopened. Consultants should be aware that distance and customs formalities may require longer than expected delivery time.
Interested Consultants are strongly advised to read all sections of this document, including the Terms of Reference and the Form of Contract, and to seek clarification during the solicitation period for this procurement. MiDA and MCC shall not entertain any requests for changes to this document subsequent to the submission of Technical and Financial proposals.
