Procurement of Recruitment Services

OMCN/Proc/003

The Government of Nepal (“Government” or “GoN”) has received grant funding from the Millennium Challenge Corporation (“MCC”), called a Compact, and intends to apply parts of the proceeds of the funds to payments for contracts for goods, works and services. MCC is a U.S. government agency focused on assisting countries dedicated to good governance, economic freedom, and investments in people. Subject to the terms and conditions of the Compact, related agreements, and the availability of funds, the Government intends to use a portion of the funds to finance staff recruitment services from a firm/organization (“Recruitment Firm” or “Consultant”) to assist the GoN with recruitment and staffing key positions of the Millennium Challenge Account of Nepal (MCA-Nepal), a Government entity, to be established and designated to serve as the accountable entity for implementing this Compact.

The Compact includes investment from MCC of up to US$500 million and an additional US$130 million from the Government, for a total of approximately US$630 million. The Compact includes two projects: (i) construction of about 300 kilometers of 400kV electricity transmission lines, three substations, and technical assistance for the power sector; and (ii) technical assistance to improve the road maintenance regime and road maintenance works on about 300 kilometers of the strategic road network. The program would include the procurement of contractors and consultants for design, construction and supervision of electricity lines and substations, road maintenance works, including a variety of technical services, equipment and construction works in different geographic locations within Nepal. These contracts will be competed through open international procurement procedures. Specifically, MCC will finance the procurement of a recruitment services, engineering design and supervision, environmental and social assessment, land acquisition and resettlement services, and construction of power lines and substations among other activities. The proposed Recruitment Firm is required to recruit the executive management and key staff of MCA-Nepal.

In issuing this RFP, the Government is represented by the Office of the Millennium Challenge Nepal (“OMCN”). Prior to the establishment of MCA-Nepal, any references to actions taken or rights received by MCA-Nepal in this RFP, including in the Form of Contract, shall be taken or received by OMCN on behalf of the Government, and any references herein to MCA-Nepal shall be deemed to mean OMCN during this period.

The OMCN/MCA-NEPAL now invites proposals from legally constituted consulting firms to provide the consultant services referenced above (“Proposals”). More details on these consultant services are provided in the Terms of Reference at Section V of this RFP. Please note that Proposals from individuals will not be reviewed.

This RFP is open to all eligible entities (“Consultants”) who wish to respond.

Recruitment Services, and the contract expected to be awarded, are required for a fixed price for a six-month Base Period, plus two Option Periods of three months each.

A Consultant will be selected under the Quality and Cost-based Selection (QCBS) method, the evaluation procedure for which is described in sections of the RFP in accordance with “MCC Program Procurement Guidelines” which are provided on the MCC website (www.mcc.gov/ppg). The selection process, as described, will include a review and verification of qualifications and past performance, including a reference check, prior to the contract award.

The RFP includes the following Sections:

PART 1 – PROPOSAL AND SELECTION PROCEDURES

Section I         Instructions to Consultants                                                                         

This section provides information to help potential Consultants prepare their Proposals; it also provides information on the submission, opening, and evaluation of Proposals and on the award of the proposed contract.

Section II        Proposal Data Sheet

This section includes provisions that are specific to this procurement and that supplement Section I, Instructions to Consultants.

Section III      Qualification and Evaluation Criteria

This section specifies the qualifications required of the Consultant and the criteria to be used to evaluate the Proposal.

Section IV A  Technical Proposal Forms

This section provides the Technical Proposal Forms which are to be completed by a potential Consultant and submitted in a separate envelope as part of a potential Consultant’s total Proposal.

Section IV B  Financial Proposal Forms

This section provides the Financial Proposal Forms which are to be completed by a potential Consultant and submitted in a separate envelope as part of a potential Consultant’s total Proposal.

Section V        Terms of Reference

This Section includes the detailed Terms of Reference that describe the nature, tasks, and duties of the consulting services to be procured.

PART 2 – CONDITIONS OF CONTRACT AND CONTRACT FORMS

Section VI      Contract Agreement and General Conditions of Contract

This section contains the draft form of Contract proposed to be entered into between the OMCN/MCA-NEPAL and Consultant.

Section VII     Special Conditions of Contract and Annexes to Contract

This section contains the form of those clauses of the Contract that supplement the GCC and that are to be completed by OMCN/MCA-NEPAL Entities for each procurement of Consulting Services. This section also includes an Annex to the Contract (Annex B: Additional Provisions) that contains provisions that are a part of the Government’s and the OMCN/MCA-NEPAL’s obligations under the Compact and related documents which, under the terms of the Compact and related documents, are required to be transferred onto any Consultant, Sub-Consultant or Associate who partakes in any MCC-funded procurement.
Please note that a Pre-Proposal Conference will be held as described in the Proposal Data Sheet (“PDS”), Section II of this RFP. Attendance at the Pre-Proposal Conference is optional, not mandatory.
