Assignment Title: Civil Aviation Legal Framework
Reference No. TSRP-C079
The Republic of CABO VERDE has received financing from the World Bank toward the cost of the Transport Sector Reform Project-TSRP, and intends to apply part of the proceeds for consulting services.
The consulting services (“the Services”) include to assess and adjust the Civil Aviation Legal Framework.
For this purpose the following global objectives must be achieved by the consultant:
1. Diagnosis, survey and systematization of what was legislated and regulated by the Government within the scope of its competences imposed by the Aeronautical Code (Master Law of civil aeronautics), but also what was regulated by AAC within the scope of its competences emanating from Aeronautical Code and its Statutes, namely the technical regulations (the so-called civil aviation regulations - CV-CAR´s and Internal Instructions);
2. Listening to the opinion of air operators in Cape Verde on the practical aspects of applying the regulation and regulation system of the air sector and the impact they have on the sustainability of their operation.
3. Assess the current legal and regulatory framework in terms of the balance that must exist between the requirements of technical and administrative regulation, on the one hand, and the dynamics of the market and the sustainability of the business, on the other.
4. Assess with AAC if there are still some specific areas of the airline sector, which need to be reinforced in terms of regulation (commercial aviation, operation with helicopters, private aviation, medical evacuation transport, recreational aviation, etc.)
If, on the one hand, Cabo Verde has made significant progress in terms of legislation and regulation of civil aeronautics, especially with regard to practices and the legal and regulatory framework of the international guidelines of the ICAO regarding the safety system of flight operation (safety and security), on the other hand, it is important that the legal and regulatory framework accompany the country´s development challenges.
In this context legislation and regulations should go beyond the application of international civil aviation rules and regulations that result from International Conventions, to promote legal mechanisms that stimulate air freedom, bilateral and multilateral cooperation, competitiveness, the sustainability of air business and the streamlining of administrative processes of authorizations, licenses and certifications, without prejudice to air safety in balance with the country´s economic development.
During the period of 6 months in which the consultancy place, the Consultant undertakes to submit the following reports:
Each of the referred reports will be presented and subject to discussion/approval by the Ministry of Tourism ad Transport, and the conclusions of the presentations should be incorporated in the report in question.
The Consultant should be available for any meetings that become necessary.
The working language must be English or Portuguese and the reports must be presented in English and Portuguese version. The Consultant must be available for meetings and seminars that become necessary.
The Ministry of Tourism ad Transport- MTT now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience in the field of civil aviation to perform the Services. The shortlisting criteria are: At least 15 years of experience in similar studies in civil aviation field; experience in providing consulting services in developing countries; availability of appropriate skills among staff in civil aviation sector. The Consultant must be a company or a consortium of companies, with specialization and minimum experience of 15 years in the field of legislation and regulation of civil aeronautics. You should have extensive experience in terms of international best practices in civil aviation regulation and knowledge of ICAO recommendations. The consulting team, which will be created, should have the following specialties:
1) Specialist in international civil aviation, with strong knowledge in terms of technical regulation processes and recommendations of international civil aviation organizations such as ICAO, EASA and FAA and with a minimum experience of 10 years;
2) Specialized and experienced jurist in terms of analysis and drafting of civil aviation laws and regulations, with a minimum experience of 10 years;
3) Local jurist, with strong knowledge in terms of the legal and regulatory framework and the processes of technical, economic and administrative regulation of civil aviation in Cape Verde, with a minimum experience of 8 years.
The attention of interested Consultants is drawn to paragraph 1.9 of the World Bank’s Guidelines: Selection and Employment of Consultants under IBRD Loans and IDA Credits & Grants by World Bank Borrowers January 2011 Revised July 2014 (“Consultant Guidelines”), setting forth the World Bank’s policy on conflict of interest.
Consultants may associate with other firms in the form of a joint venture or a sub consultancy to enhance their qualifications.
A Consultant will be selected in accordance with the Selection Based in the Consultants’ Qualifications-CQS method set out in the Consultant Guidelines.
