Technical Assistance Preparatory Services Environmental, Social & Gender Screening Tools and Resettlement Policy Framework

1. The Millennium Challenge Corporation (“MCC”) and the Government of Cape Verde (the “Government”) have entered into a Millennium Challenge Compact for Millennium Challenge Account assistance to help facilitate poverty reduction through economic growth in Cape Verde (the “Compact”) in the amount of approximately $66.2 million USD (“MCC Funding”). The Government, acting through the Millennium Challenge Account – Cape Verde II (“MCA Entity,” “MCA-Cape Verde II,” or MCA-CV II”), intends to apply a portion of the MCC Funding to eligible payments under a contract for which this Terms of Reference is issued. Any payments made under the proposed contract will be subject, in all respects, to the terms and conditions of the Compact and related documents, including restrictions on the use of MCC funding and conditions to the disbursements of MCC funding. No party other than the Government, MCA-CV II and MCC shall derive any rights from the Compact or have any claim to the proceeds of MCC Funding.
2. The Compact program includes a $41.1 million Water, Sanitation, and Hygiene (WASH) Project is designed to establish a financially sound, transparent and accountable institutional basis for the delivery of water and sanitation services to Cape Verdean households and businesses and a $17.3 million Land Management for Investment Project is expected to improve Cape Verde’s investment climate by refining the legal, institutional and procedural environment to create conditions for increased reliability of land information, greater efficiency in land administration transactions, and strengthened protection of land rights; developing and implementing a new land information management system; and clarifying parcel rights and boundaries on targeted islands with high investment potential. In furtherance of the Compact, mainly the Land Management for Investment Project, the Millennium Challenge Account Cape Verde II (“MCA-Cape Verde II”) requires the services of a consulting firm to carry out a number of preparatory activities in respect to the implementation of the LMIP’s Activity 2, Rights and Boundaries Clarification.
This specific TOR describes services to produce the environmental, social and gender screening tools that will enable eventual Activity 2 fieldwork implementers to identify key constraints to land rights and boundaries clarification and opportunities to improve outreach to and engagement of vulnerable groups during the Activity 2 fieldwork implementation. In addition, given the overall lack of conclusive information about rights and boundaries in many cases, there are a number of potential disputes and conflicts between private parties as well as between private parties and public land holders, stakeholders and public goals. Ultimately, these issues will need to be resolved in order to provide a clear registration of ownership of each parcel of land. The development of tools for identifying and screening potential environmental, social and gender constraints and opportunities associated with the mapping of parcels, identification of rights claims and adjudication and registration of land rights during the LMI Project’s Activity2.
Component 2 of Activity 2 Fieldwork Operations Manual – Resettlement Policy Framework The development of a Resettlement Policy Framework to support disputeresolution approaches between private and State parties, defining procedures consistent with Cape Verdean law and meeting the minimum standards defined in IFC Performance Standard 5 on Land Acquisition and Involuntary Resettlement. While the framework for resolution of disputes between private parties is being developed by another consultant, this RPF component will include checklist tools that can be used by field implementers to identify the type of dispute between the State (central or municipal) and private parties. This component will also be directly used during the fieldwork of LMI Project Activity 2.

Before applying, interested consultants should review the Terms of Reference (TOR) that describes the assignment in detail. The required qualifications for the Consultant to be considered are indicated in the TOR. A full set of instructions document (RCQ) in English, including the Terms of Reference (TOR), may be requested by the interested Consultancy Firms in writing to the address below.
The RCQ document will be sent in PDF format by e-mail. The selection shall be carried out in accordance with the procedures set forth in Section 1.B. of the MCC Program Procurement Guidelines (PPG) for “Selection Based on the Consultant’s Qualifications (CQS),” which are available on the ―Business & Procurements‖ page of the MCC website (http://www.mcc.gov).
The selected consultant will sign a contract on the basis of a fixed price/fee lump sum. Eligibility Consultants (including their associates, if any), their Sub-Consultants and Personnel, shall satisfy the eligibility criteria set forth in the RCQ document, as contained in the “MCC Program Procurement Guidelines” governing MCC-funded procurements under the Compact.
