Assignment Title: REFORM OF SUBSOIL POLICIES AND INSTITUTIONS WITH CAPACITYBUILDING FOR IMPLEMENTATION

Reference No.: PSC/QCBS2

The Republic ofTajikistan has received Grant for financing in the amount of US$ 10 Millionequivalent from the World Bank toward the cost of thePrivate Sector Competitiveness Project, and it intends to apply part of theproceeds to payments for consulting services. The services include Support to the Government of Tajikistan for the reform of the draft Law on Subsoil and ImplementingRegulations.

The objective of thisassessment is to ensure a comprehensive and participatory assessment of the laws, policies and regulations that shape Tajikistan's miningregime, largelygoverned by the Subsoil Law.

Support to the GoT on thedrafting of the new Subsoil and Subsoil using Law, implementing regulations in the mining sector, and institutional structure foragencies with mining functions to bring them in line with international best practices:

·         Assessment and recommendations on developing alaw specific to mining sector activities[1];

·         Support to the GoT on revisions to the miningfiscal regime including an assessment of the total fiscal burden on mining operations;

·         Support to the GoT on the organizationalstructure for the mining, cadastre and geological survey functions carried out by variousagencies of the GoT, including anassessment and recommendations on institutional design and responsibilities, current and future staffing needs, and a trainingstrategy for staff in key regulatory roles.

·         Support to the GoT on policies and regulationsfor tenderingof known mineral deposits (given the large amount of unexploited resources that were identified in the Soviet period);this would include the environmental and social provisions and regulations that prospective mine operators would be contractuallyand legally bound to adhere to.

·         Support to the GoT on programs and policies toenhance the domestic impacts of mining operations in the areas of mine site employment, procurement of local goods and services bymining companies and associated employment (e.g. surveying, food supply, mine clothing, servicing heavy machinery, small machineshop works), and infrastructure (through shared infrastructure or private-public partnerships where feasible);and

·         Provision and delivery of training programs todevelop improved staff skills in relevant GoT agencies, including issues in the areas of the monitoring and evaluation ofenvironmental and social impacts and benefit streams management.

The State Committee for Investments and StateProperty Management (SCISPM) now invites eligible consultants to indicate their interest in providing the services.Interested consultants must provide information demonstrating that they have the required qualifications and relevant experience toperform the Services..  

The shortlisting criteria are:

·         The firm should have minimum 10 years ofexperience in implementing regulations in the mining sector, and institutional structure for agencies with mining functions tobring them in line with international best practices;

·         The firm should have practical experience onprocurement in the mining sector;

·         The firm should have practical experience intraining programs to develop improved staff skills.

Ability of theapplicant to work in Russian and/or Tajik would be considered an advantage.

The attention of interested Consultants is drawn to paragraphs 1.9 and 1.11 of the World Bank'sGuidelines: Selection and Employment ofConsultants under IBRD Loans and IDA Credits & Grants by World Bank Borrowers published in January 2011.("ConsultantGuidelines"), setting forth the World Bank's policy on conflict of interest and eligibility.

Consultants may submit their REOI as an individualfirm or in association in the formof a joint venture or  sub consultancy. All the members of the joint venture shall bejointly and severally liable for the entire assignment.  However, the experience of sub-consultant will not be considered while short-listing.

A Consultant will be selected in accordance with the Quality andCost-Based Selection method set out in theConsultant Guidelines.
