Objective and Purpose of the Assignment
   
The main objective of this consultancy service is to review poorly performing civil works contracts 
awarded by Implementing Agencies (IA) in Sri Lanka under the ADB funded projects and recommend actions 
to complete construction works.

Substantial delays have been reported in five civil works contracts awarded under Dry Zone Urban Water 
Supply Project (DZUWSP) and Greater Colombo Wastewater Management Project (GCWWMP). Both projects will 
not be able to complete on schedule loan closing dates unless actions are taken to improve construction 
progress. ADB has decided to field a Contract Specialist to review contract agreement, implementation 
issues and identify possible solutions to resolve construction issues.

Three of the projects identified as poor performing are in DZUWSP. These are BOQ type contracts related 
to water source development, water treatment plant construction and supply and laying of water pipes. 
Two contracts are in GCWWMP. One contract is a design and built type contract for sewer pump house 
improvement and the other contract is a BOQ type contract for sewer pipe supply and laying.
Scope of Work
   
The consultant’s responsibilities will include, but not be limited to:

I. Review contracts signed between IAs and each contractor including any subsequent contract variations 
and correspondence;

ii. Review construction progress and identify reasons for construction delays in each contract. The 
consultant will meet IAs, supervision consultants, and/or contractors where necessary; 

iii. Analyze possible solutions to improve construction progress of each contract. Solutions include:  
actions against contractors, contract termination by IA, mutual termination, possibilities to carry out 
uncompleted works through contract variations to well performing contractors, or through new contracts;

iv. Recommend ADB and IA for actions to be taken with identification of potential risks associated with 
implementation of recommended actions;

v. Review the bidding process of the subject contracts and recommend ADB for actions to be taken in 
future contract to avoid construction delays.
Detailed Tasks and/or Expected Output
   
The consultant will report to Sri Lanka Resident Mission staff directly and in writing regarding the 
main outputs and projected work and activities during the assignment. Consultant should submit the two 
final report, Report One within two weeks of completion of field investigations and document review (for 
C- i, ii, iii and iv)  and Report Two: within one week of completion of document review (for C -v).  

The consultant will be recruited under a lump sum contract for 24 days (20 days for Report One and 4 
days for Report Two) to be undertaken in September (for Report One) – October (for Report Two) 2016. The 
consultant’s engagement shall be in accordance with the direct selection process using ADB’s Guidelines 
on the Use of Consultants. Work will be done at Colombo and project sites in Colombo, Chilaw, Puttalam 
and Vavuniya under the supervision of the SLRM staff.
Minimum Qualification Requirements
   
The consultant should have:

i. expertise in FIDIC contract management and should have previous experience in handling similar issues 
in FIDIC contracts;

ii. professional qualifications in  Civil Engineering, B.Sc or equivalent with minimum of 10 years of 
experience in contract management; and

iii. good oral and written communication in English.
