Consultancy services for development of the design and tender documentation as well as the supervision of construction works on M-01 Road Kyiv – Chernigiv – Novi Yarylovychi (Lot 4) and М-06 Kyiv – Chop in a capacity of the Engineer with subsequent design supervision
This request for expressions of interest follows the updated General Procurement Notice No. 7969-GPN-40185 for this project published on the EBRD’s web-site on August 10, 2015.
The State Road Agency of Ukraine (Ukravtodor) has received financing from the European Bank for Reconstruction and Development and European Investment Bank toward the cost of the Pan-European Corridors Project (the “Project”) and intends to apply the proceeds to payments for consulting services for the Design and Supervision of the civil works (Construction works on M-01 Road Kyiv – Chernigiv – Novi Yarylovychi (Lot 4) and М-06 Kyiv – Chop) in a capacity of the Engineer with subsequent design supervision.
One of the project components is rehabilitation of M-01 Kyiv – Chernigiv – Novi Yarylovychi road. The Works under Lot 4 on this road include the construction of the traffic interchanges on different levels at km 23+150, km 27+580, km 40+330, km 83+200 and rehabilitation of traffic interchange on km 36+482.
The second component of the project is rehabilitation of М-06 Kyiv – Chop highway, and includes construction of construction of 11 footbridges, on km 22+960, km 30+800, 36+870, km 39+170, km 40+420, km 43+560, km 45+240, km 48+190, km 50+790, km 66+950 and km 105+780.
Ukravtodor requires the following services under this assignment with respect to the Works, but not limited to: (a) design services, (b) tender documentation development, (c) design supervision of construction and rehabilitation works, (d) establishment of systems of managerial control for civil works contracts, (e) the Engineer’s administration of Contracts, (f) control over estimated works quantities and contract outcome costs, in monitoring the progress of the Works and technical records; (g) control and acceptance of contractor’s interim and final payment certificates; (h) the acceptance and/or approval of Contractors’ key staff, insurances, guarantees, licenses, programs, method statements, traffic management plans, safety measures, suppliers and materials for incorporation in the works, the quality assurance and control plans, laboratory provisions and execution of the testing program, subcontractors, plant, equipment and environmental protection; (h) direct supervision of the works and monitoring of progress; (j) the preparation of progress, technical and contractual reports, (k) execution of the control tests of all materials intended for incorporation into permanent works and the all executed works.
The Employer invites expressions of interest from suitably qualified firms who are interested in providing the Design and Supervision of the civil works and carrying out the duties of 'the Engineer' in accordance with the contract for all of the above works which will be based upon FIDIC-MDB Harmonized Edition of the Conditions of Contract for Construction, March 2010.
In order to successfully implement the assignment, it is envisaged that the consultant’s team will consist of the following Key-experts:
1 (one) Project Director/Engineer;
1 (one) Chief Designer;
1 (one) Chief Resident Engineer;
1 (one) Senior Materials (Quality Assurance) Engineer;
1 (one) Senior Highway/Bridge Engineer;
1 (one) Environmental Engineer;
1 (one) Procurement specialist.
Also, the Consultant shall envisage the group of following technical support staff:
3 (three) Deputy Resident Engineer
2 (two) Material (Quality Assurance) Engineer
1 (one) Highway Engineer
1 (one) Bridge Engineer
3 (three) Quantity Surveyors
2 (two) Land Surveyor
3 (three) Inspectors (certified technical supervision engineers)
1 (one) Road Safety Specialist
1 (one) Laboratory Technician
1 (one) Social and Environmental Specialist
2 (two) Translators/Secretaries
Assignment Start Date and Duration: The assignment is expected to commence from the moment of signing of the Agreement (approximately in September 2016).
Eligibility: Procurement will be open for all the Consultants except those restricted in the EBRD’s list of ineligible entities. The proceeds of the loan shall not be used for the purpose of any payment to persons or entities or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations and the Client’s Country prohibitions.
The time for implementation of the design development is 1 month for the surveys and investigation and Technical Conditions collection and 3 months for design documents preparation.
The time for implementation of tender documents preparation is 3 weeks after the designs are submitted to the Expertise.
The time for implementation of Supervision services shall be three years and 4 months, where two years are needed for construction period, one year for the services during Defects Liability Period and 4 months for post-DLP services.
Status: in order to determine the capability and experience of consulting firms seeking to be short-listed, the information submitted shall include:
Company profile, organization and staffing;
Details of experience or similar assignments undertaken in the previous five years, including their locations (the information submitted shall include for each project, as a minimum, the following:
project title;
contractual role of the firm;
the presence of any affiliate or parent companies and their respective roles;
location, start and completion dates;
value;
name of the Client;
funding source, objectives and brief narrative description of the project;
functions and tasks carried out;
applicable national and/or international codes and standards, and certification.
CVs of staff available to work on the assignment;
The consulting firms seeking to be short-listed, requires having the following experience:
experience in designing multilevel transport interchanges design development, in accordance with international standards and Ukrainian legal framework;
experience in ensuring implementation of permission and approval procedures in civil engineering sphere, in accordance with Ukrainian regulatory acts;
experience in preparation of tender documents based on FIDIC contract conditions and EBRD standard tender documents for Works;
international and regional experience in supervision under FIDIC contracts conditions and in projects financed by international financing institutions.

Procurement procedure: Procurement of the consultancy services will be conducted through the procedures as specified in the EBRD’s Procurement Policies and Rules (PP&R) dated May, 2014. The consultants will be selected under Quality-and Cost-Based Selection (QCBS).
One shortlist of qualified firms will be prepared on the response to this invitation, after which short-listed firms will be invited to submit their proposals.
If the Consultant has been found by a judicial process or other official enquiry to have engaged in any of the Prohibited Practices as defined in the EBRD PP&R, details of the basis for the outcome of such process or enquiry shall be provided with the expression of interest.
The Employer reserves the right not to shortlist consulting firms that have been found to have engaged in corrupt or fraudulent practices regardless of the results of technical evaluation of the expressions of interest. If a firm considers it does not possess all the required expertise for the assignment, it may consider forming a joint venture partnership with other firms. In such cases the Expression of Interest should provide the aforementioned details for each partner and an indication which firm is the lead partner. The above information should not exceed 50 pages.

Three (3) copies of the above information in Ukrainian and one (1) copy in English should be submitted to the address below in a sealed envelope marked as «Expression of Interest for the Pan-european Corridors Project/European Roads Ukrane II: Consultancy services for development of the design and tender documentation as well as the supervision of construction works on M-01 Road Kyiv – Chernigiv – Novi Yarylovychi and М-06 Kyiv – Chop in a capacity of the Engineer with subsequent design supervision» and must be delivered in a printed form to the address below (in person, or by mail) before 17:00 (Local time) July 1, 2016.
Please note that submission of Expressions of Interest that do not comply with these requirements will be rejected.
Expressions of interest received after this time and date shall not be considered and will be returned unopened.
